TERMS AND CONDITIONS: BESTDRIVE CONTINENTAL AMG DRIVING EXPERIENCE PROMOTION

Please read these Terms and Conditions carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate. These Terms and Conditions are governed by the Consumer Protection Act, 68 of 2008, and the Protection of Personal Information Act, 4 of 2013.

The Terms and Conditions set out below apply to all participants in the BestDrive Continental AMG Driving Experience Promotion taking place on BestDrive’s Facebook, Instagram, TikTok, point-of-sale material, print, digital, direct marketing and any other media channels used by the Promoter for the Promotion.

Important clauses, which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgement of any fact, or involve some risk for you, are in bold and italics. You must pay special attention to these clauses.

1. THE PROMOTION

1.1  The BestDrive AMG Driving Experience Promotion ("Promotion") is conducted by BestDrive South Africa (Pty) Ltd ("Promoter"), registration number 2013/059163/07, with its principal place of business at Cadle Street, New Brighton West, Gqeberha, South Africa.

1.2  The Promotion is a promotional competition as contemplated under section 36 of the Consumer Protection Act, 68 of 2008, and is conducted in accordance with these Terms and Conditions and applicable South African law.

1.4  This Promotion is not sponsored, endorsed, administered by or associated with Meta, Facebook, Instagram, TikTok, Google, or any media owner through which the Promotion may be advertised.

2. THE PROMOTION PERIOD

2.1  The Promotion will run from 1 August to 22 August 2026, both dates inclusive, unless extended, curtailed, suspended or cancelled in accordance with these Terms and Conditions.

2.2  Entries received before the commencement date or after the closing date will not be eligible, unless the Promoter lawfully extends the Promotion and communicates such extension through the same or substantially similar channels used to advertise the Promotion.

3. WHO MAY PARTICIPATE

3.1  Participants must:

• • Be natural persons who are at least eighteen (18) years of age at the date of entry;
  • Be citizens or lawful residents of the Republic of South Africa;
  • Hold a valid South African identity document or valid passport with lawful residence or work authorisation;
  • Must self-identify as female. This must be reflected in a valid South African Identity Document or passport. The Promoter reserves the right to request documentation confirming gender as officially recognised for eligibility verification purposes;
  • Hold a valid South African driver’s licence.
  • Purchase qualifying Continental-branded tyres from a participating BestDrive dealership during the Promotion Period.

3.2  The Promotion is open to retail consumers only. Fleet, account, wholesale, trade or business purchases do not qualify.

3.3  Participation excludes the Promoter’s directors, members, partners, employees, consultants, agencies, promotional and advertising agents, merchandisers, participating stores, competition organisers and the immediate family members, life partners, business partners or associates of any of the aforesaid persons.

4. PROMOTION CRITERIA AND ENTRY MECHANICS

4.1  Consumers who purchase any qualifying Continental-branded tyres, size 17 inch and above, at any participating BestDrive dealership during the Promotion Period may enter the Promotion and stand a chance to win one (1) of five (5) AMG Driving Experiences at the Zwartkops Raceway.

4.2  Each valid qualifying invoice entitles the participant to one (1) entry into the Promotion. Duplicate entries using the same invoice will not be accepted.

4.3  Register the qualifying tyre purchase on the ContiSure platform during the Promotion Period and give consent to receive further communication from Continental Tyres SA in order for the Promoter to make contact if selected as a winner.

4.4   Successful registration on ContiSure will automatically constitute entry into the Promotion.

4.5   Participants must provide all information reasonably required to complete the ContiSure registration process.

4.6 The Promoter may conduct reasonable audits and verification checks in respect of purchases, registrations and participant information and reserves the right to disqualify any participant whose entry cannot be verified.

5. QUALIFYING CONTINENTAL-BRANDED TYRES

5.1  The following Continental-branded tyres, size 17 inch and above, qualify for the Promotion, provided they are purchased by retail consumers from a participating BestDrive dealership during the Promotion Period:

• • passenger tyres;
  • light truck tyres;
  • 4x4 tyres; and
  • van tyres.

5.2  For the avoidance of doubt, tyres below 17 inch, non-Continental-branded tyres, fleet purchases, account purchases, wholesale purchases, trade purchases and business purchases do not qualify.

6. PRIZE

6.1 Five (5) winners will each receive one (1) AMG Driving Experience at Zwartkops Raceway scheduled to take place on 9 September 2026.

6.2 Each prize includes:

• • advanced driving instruction;
  • skidpan training;
  • hospitality with lunch; and

6.3 Winners residing outside Gauteng will receive flights, accommodation and selected meals as determined by the Promoter.

6.4 Winners residing within Gauteng will be responsible for their own transport arrangements to and from Zwartkops Raceway.

6.5 Any incidental expenses not expressly included in the prize remain the responsibility of the winner.

6.6 The prize is not transferable, exchangeable or redeemable for cash.

6.7 The Promoter reserves the right to substitute the prize, or any part thereof, with a prize of similar value should circumstances beyond its reasonable control require such substitution.

7. AWARDING OF PRIZE

7.1 A lucky draw will be conducted on 26 August 2026 from all valid and verified entries received during the Promotion Period.

7.2 Five (5) winners plus additional reserve winners will be selected.

7.3 Winners will be contacted using the consent and contact details provided during the ContiSure registration process.

7.4 If a selected winner cannot be contacted within two (2) business days, fails to provide any further required verification information, declines the prize, or is found to be ineligible, the Promoter may disqualify that winner and select an alternative eligible winner.

7.5 Winners must hold a valid South African driver's licence and comply with all safety, participation, indemnity and operational requirements imposed by the event organiser, Mercedes-AMG Driving Academy, Zwartkops Raceway and any appointed third-party service providers.

7.6 Failure to meet the participation requirements may result in forfeiture of the prize.

7.7 The Promoter's decision regarding winner selection, eligibility and prize allocation is final, subject to applicable law.

7.8 By accepting the prize, winners may consent to having their name, image and likeness used in the Promoter's marketing communications and social media channels for purposes of announcing the Promotion winners. Publicity consent is voluntary and a winner who does not consent to publicity will still receive the prize, provided all eligibility and verification requirements are met.

 8. LIMITATION OF LIABILITY

8.1  To the fullest extent permitted by law, the Promoter, its associated companies, directors, officers, employees, agents and service providers shall not be liable for any loss, damage, injury, expense, event cancellation, postponement, venue change, seating change, travel disruption, logistical issue, technical failure, network failure, WhatsApp failure, or delay arising from participation in the Promotion or acceptance or use of the prize, except to the extent caused by the Promoter’s gross negligence, wilful misconduct or fraud.

8.2  The Promoter shall not be responsible for any act, omission, cancellation, postponement, delay, restriction or requirement of any third-party event organiser, venue operator, transport provider, restaurant, ticketing provider, media platform, network operator or other third party, except to the extent required by law.

8.3  If any match or related event is cancelled, postponed, materially changed, or becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter may substitute the prize with a prize of similar value where reasonably possible, or cancel the affected prize element without further liability, subject to applicable law.

9. INDEMNITY

9.1  To the extent permitted by the Consumer Protection Act and any other applicable law, the participant indemnifies the Promoter, its associated companies, directors, officers, employees, agents and service providers against any loss, damage, claim, liability, cost or expense arising from the participant’s breach of these Terms and Conditions, unlawful conduct, fraudulent conduct, negligent conduct, misuse of the prize, breach of venue rules, or provision of false or misleading information, except to the extent that such loss is caused by the Promoter’s gross negligence, wilful misconduct or fraud.

9.2  Nothing in these Terms and Conditions excludes or limits any liability that may not lawfully be excluded or limited under the Consumer Protection Act or any other applicable law.

10. PROCESSING OF PERSONAL INFORMATION

10.1  In addition to the Promoter’s applicable privacy and processing notices, this clause explains how BestDrive South Africa (Pty) Ltd, as the Responsible Party under POPIA, collects, uses, stores and shares personal information for purposes of administering the Promotion.

10.2  The Promoter and its appointed service providers, including, may process participants’ personal information, including name, surname, cellphone number, email address, ID or passport number, invoice details, dealership details, WhatsApp communication details and, where applicable, image or likeness, for the purposes of administering the Promotion, verifying entries, selecting and contacting winners, allocating prizes, keeping legally required records, performing audits, preventing fraud, complying with legal obligations and responding to lawful requests from regulators or authorities.

10.3  Personal information may be collected directly from participants, from the relevant BestDrive dealership, or from service providers who collect information on behalf of the Promoter.

10.4  Where the Promoter uses service providers to process personal information on its behalf, the Promoter will require such service providers to process personal information only for authorised purposes and to apply appropriate safeguards.

10.5  The supply of personal information is voluntary. However, if a participant does not provide the information reasonably required to verify entry and administer the Promotion, the participant may not be able to participate or receive a prize.

10.6  Marketing consent is optional and is not required to enter the Promotion. Marketing communications will only be sent to participants who have expressly opted in, or where otherwise permitted by POPIA. Participants may withdraw marketing consent at any time by using the opt-out mechanism provided or by contacting the Promoter.

10.7  The Promoter may use winners’ names, images and likenesses for publicity only where lawful and, where required, with the winner’s consent. A winner may decline publicity and will still receive the prize if all eligibility and verification requirements are met.

10.8  Personal information will be retained only for as long as required for the purposes for which it was collected, including legally required promotional competition record retention, audit, dispute, regulatory and compliance purposes. Where there is no lawful basis to retain the information, it will be deleted, destroyed or de-identified.

10.9  Participants have the right to request access to, correction of, or deletion of their personal information on reasonable grounds, subject to applicable law. Requests may be sent to BestDrive South Africa (Pty) Ltd, Cadle Street, New Brighton West, Gqeberha, Attention: Compliance Department, or to dataprotection@conti.co.za.

10.10  The Promoter’s privacy policy is available at https://www.bestdrive.co.za/data-security.

11. GENERAL

11.1  The Promoter may amend, postpone, suspend, cancel or terminate the Promotion, or amend these Terms and Conditions, where reasonably necessary due to circumstances beyond its reasonable control, legal or regulatory requirements, event cancellation or postponement, suspected fraud, operational reasons, technical issues, or other reasonable cause. Where reasonably practicable, the Promoter will give prior notice through the same or substantially similar channels used to advertise the Promotion.

11.2  Participants are responsible for checking the Promotion website or official Promotion channels for updates to these Terms and Conditions.

11.3  The Promoter may refuse to accept an entry, disqualify a participant, refuse to award a prize, or recover a prize already awarded if the Promoter reasonably believes that the participant is not eligible, has breached these Terms and Conditions, has acted fraudulently, dishonestly, unlawfully or abusively, has attempted to manipulate or circumvent the Promotion mechanics, has submitted false or misleading information, or if it would be unlawful to award the prize.

11.4  Any participant suspected of fraud or material misconduct may be disqualified from this Promotion and future promotions run by the Promoter or its associated agents.

11.5  If any provision of these Terms and Conditions is found to be illegal, invalid or unenforceable, that provision will be read down to the extent necessary to make it legal, valid and enforceable. If it cannot be read down, it will be severed, and the remaining provisions will continue to apply.

11.6  This Promotion is not applicable in conjunction with any other offer or promotion offered by the Promoter, unless expressly stated otherwise in writing.

11.7  These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute arising from or in connection with the Promotion will be subject to the jurisdiction of the courts of the Republic of South Africa, subject to any rights participants may have under applicable consumer protection or data protection law.
