TERMS AND CONDITIONS: BESTDRIVE MIDYEAR NON-SA DRIVE WIN DINE PROMOTION

Please read these Terms and Conditions carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate. These Terms and Conditions are governed by the Consumer Protection Act, 68 of 2008, and the Protection of Personal Information Act, 4 of 2013. 
 
The Terms and Conditions set out below apply to all participants in the BestDrive Drive, Win and Dine Promotion taking place on BestDrive’s Facebook, Instagram, TikTok, point-of-sale material, print, digital, direct marketing and any other media channels used by the Promoter for the Promotion. 
 
Important clauses, which may limit our responsibility, place an obligation on you to indemnify us, involve an acknowledgement of any fact, or involve some risk for you, are in bold and italics. You must pay special attention to these clauses. 

1. THE PROMOTION

1.1 The BestDrive Midyear Non-SA Drive Win Dine Promotion ("Promotion") is conducted by BestDrive South Africa (Pty) Ltd ("Promoter"), registration number 2013/059163/07, with its principal place of business at Cadle Street, New Brighton West, Gqeberha, South Africa. 

1.2 The Promotion is a promotional competition as contemplated under section 36 of the Consumer Protection Act, 68 of 2008, and is conducted in accordance with these Terms and Conditions and applicable South African law. 

1.3 This Promotion is not sponsored, endorsed, administered by or associated with Meta, Facebook, Instagram, TikTok, Google, or any media owner through which the Promotion may be advertised. 

2. THE PROMOTION PERIOD

2.1 The Promotion will run from 1 to 22 July 2026, both dates inclusive, unless extended, curtailed, suspended or cancelled in accordance with these Terms and Conditions. 

2.2 Entries received before the commencement date or after the closing date will not be eligible, unless the Promoter lawfully extends the Promotion and communicates such extension through the same or substantially similar channels used to advertise the Promotion. 

3. WHO MAY PARTICIPATE

3.1 Participants must be natural persons who are at least eighteen (18) years of age; lawful residents of Botswana, Namibia or Eswatini; and must purchase qualifying Continental-branded tyres from a participating BestDrive dealership during the Promotion Period.

3.2 The Promotion is open to retail consumers only. Fleet, account, wholesale, trade or business purchases do not qualify. 

3.3 Participation excludes the Promoter’s directors, members, partners, employees, consultants, agencies, promotional and advertising agents, merchandisers, participating stores, competition organisers and their immediate family members. 

4. PROMOTION CRITERIA AND ENTRY MECHANICS

4.1 Consumers must purchase two or more “17 inch and larger” Continental?branded tyres from a participating BestDrive dealership in the relevant market during the Promotion Period.                                                                                                                            

4.2 To enter, consumers must scan the Promotion QR code displayed on the point-of-sale material.                                                                                 

4.3 The QR code will direct the consumer to the Promotion entry page, where the consumer must upload a copy of their qualifying invoice for verification.                                            

4.4 Required information includes the customer’s name, contact number, invoice number, tyre size, quantity purchased and vehicle registration number.                                                        

4.5 Once the invoice has been successfully verified, the consumer will be entered into the Promotion.                                                                               

4.6 The restaurant or hotel will be selected and booked by the winner.                                                

4.7 Winners will be contacted using the contact details provided during entry.

5. QUALIFYING CONTINENTAL-BRANDED TYRES

5.1 The following Continental-branded tyres, size 17 inch and above, qualify for the Promotion, provided they are purchased by retail consumers from a participating BestDrive dealership during the Promotion Period, no fleet business:

• • passenger tyres;
  • light truck tyres;
  • 4x4 tyres; and
  • van tyres.

6. PRIZE

6.1 Three (3) weekly cash prizes of (E, N$ or P)2?000, depending on local currency, will be awarded to selected winners to be used towards a family dining experience.                                                                                                 

6.2 The restaurant or venue is selected by the winner. 

6.3 The prize is not transferable.

7. AWARDING OF PRIZES

7.1 Weekly random draws will be conducted and winners will be contacted via the mobile phone details submitted in the competition entry form.

7.2 The Promoters decision is final, and no correspondence will be entered into.

7.3 The winner is required to provide proof of their banking details.                                                                      

7.4 Should the winner not be contactable via cellphone within three days to claim the prize and provide verify their details, the prize will be transferred to the next randomly selected entry.

7.5 The prize will be paid to the customer within 21 working days from the date of submission of documents required in 7.3   

7.6 Winners will be announced via BestDrive social media and digital platforms.

8. INDEMNITY

8.1  To the extent permitted by the Consumer Protection Act and any other applicable law, the participant indemnifies the Promoter, its associated companies, directors, officers, employees, agents and service providers against any loss, damage, claim, liability, cost or expense arising from the participant’s breach of these Terms and Conditions, unlawful conduct, fraudulent conduct, negligent conduct, misuse of the prize, breach of venue rules, or provision of false or misleading information, except to the extent that such loss is caused by the Promoter’s gross negligence, wilful misconduct or fraud.

8.2  Nothing in these Terms and Conditions excludes or limits any liability that may not lawfully be excluded or limited under the Consumer Protection Act or any other applicable law.

9. PROCESSING OF PERSONAL INFORMATION

9.1  In addition to the Promoter’s applicable privacy and processing notices, this clause explains how BestDrive South Africa (Pty) Ltd, as the Responsible Party under POPIA, collects, uses, stores and shares personal information for purposes of administering the Promotion.

9.2  The Promoter and its appointed service providers, including WOW, may process participants’ personal information, including name, surname, cellphone number, email address, ID or passport number, invoice details, dealership details, WhatsApp communication details and, where applicable, image or likeness, for the purposes of administering the Promotion, verifying entries, selecting and contacting winners, allocating prizes, keeping legally required records, performing audits, preventing fraud, complying with legal obligations and responding to lawful requests from regulators or authorities.

9.3  Personal information may be collected directly from participants, from the relevant BestDrive dealership, or from service providers who collect information on behalf of the Promoter.

9.4  Where the Promoter uses service providers to process personal information on its behalf, the Promoter will require such service providers to process personal information only for authorised purposes and to apply appropriate safeguards.

9.5  The supply of personal information is voluntary. However, if a participant does not provide the information reasonably required to verify entry and administer the Promotion, the participant may not be able to participate or receive a prize.

9.6  Marketing consent is optional and is not required to enter the Promotion. Marketing communications will only be sent to participants who have expressly opted in, or where otherwise permitted by POPIA. Participants may withdraw marketing consent at any time by using the opt-out mechanism provided or by contacting the Promoter.

9.7  The Promoter may use winners’ names, images and likenesses for publicity only where lawful and, where required, with the winner’s consent. A winner may decline publicity and will still receive the prize if all eligibility and verification requirements are met.

9.8  Personal information will be retained only for as long as required for the purposes for which it was collected, including legally required promotional competition record retention, audit, dispute, regulatory and compliance purposes. Where there is no lawful basis to retain the information, it will be deleted, destroyed or de-identified.

9.9  Participants have the right to request access to, correction of, or deletion of their personal information on reasonable grounds, subject to applicable law. Requests may be sent to BestDrive South Africa (Pty) Ltd, Cadle Street, New Brighton West, Gqeberha, Attention: Compliance Department, or to dataprotection@conti.co.za.

9.10  The Promoter’s privacy policy is available at https://www.bestdrive.co.za/data-security.

10. GENERAL

10.1  The Promoter may amend, postpone, suspend, cancel or terminate the Promotion, or amend these Terms and Conditions, where reasonably necessary due to circumstances beyond its reasonable control, legal or regulatory requirements, event cancellation or postponement, suspected fraud, operational reasons, technical issues, or other reasonable cause. Where reasonably practicable, the Promoter will give prior notice through the same or substantially similar channels used to advertise the Promotion.

10.2  Participants are responsible for checking the Promotion website or official Promotion channels for updates to these Terms and Conditions.

10.3  The Promoter may refuse to accept an entry, disqualify a participant, refuse to award a prize, or recover a prize already awarded if the Promoter reasonably believes that the participant is not eligible, has breached these Terms and Conditions, has acted fraudulently, dishonestly, unlawfully or abusively, has attempted to manipulate or circumvent the Promotion mechanics, has submitted false or misleading information, or if it would be unlawful to award the prize.

10.4  Any participant suspected of fraud or material misconduct may be disqualified from this Promotion and future promotions run by the Promoter or its associated agents.

10.5  If any provision of these Terms and Conditions is found to be illegal, invalid or unenforceable, that provision will be read down to the extent necessary to make it legal, valid and enforceable. If it cannot be read down, it will be severed, and the remaining provisions will continue to apply.

10.6  This Promotion is not applicable in conjunction with any other offer or promotion offered by the Promoter, unless expressly stated otherwise in writing.

10.7  These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute arising from or in connection with the Promotion will be subject to the jurisdiction of the courts of the Republic of South Africa, subject to any rights participants may have under applicable consumer protection or data protection law.
