Please read these Terms and Conditions carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions.  If you do not agree with these Terms and Conditions, please do not participate.

The Terms and Conditions set out below apply to all participants in the BestDrive getalot more campaign promotion taking place on BestDrive’s Facebook, Instagram, Point of Sale, Print, Billboards, Digital and any other media channels.

Important clauses, which may limit our responsibility; place an obligation on you to indemnify us; involve an acknowledgment of any fact; or involve some risk for you, will be in bold and italics. You must pay special attention to these clauses.

1. THE PROMOTION

1.1 The BestDrive getalot more promotion ("the Promotion") is conducted by BestDrive South Africa (Pty) Ltd (“the Promoter”), with registration number 2013/059163/07 and principal place of business at Cadle Street, New Brighton West, Gqeberha.

1.2 The promotion is administered by an independent agency; WOW Marketing Services (Pty) Ltd (WOW).

1.3 This giveaway, lucky draw and bonus prize is not sponsored, endorsed, or administered by Meta (Facebook/Instagram), Takealot, Google or any other media owner.

2. THE PROMOTION PERIOD

2.1 The Promotion will take place from 11 November 2024 (the commence date inclusive) to 7 December or until total number of vouchers (in total valued at R1.5 million) or Continental branded tyre stock last, whichever comes first.

2.2 The duration of the Promotion may be extended or curtailed at the discretion of the Promoter.

3. WHO MAY PARTICPATE

3.1 All Participants must:

a. be a natural person and at least eighteen (18) years of age at the date of entry.

b. be a citizen of the Republic of South Africa, Botswana, Namibia and Swaziland and/or a legal resident of these countries.

c. be in possession of a valid South African, Botswanan, Namibian and Swati Identity Document or passport with a residence/work permit.

3.2 Participation in this Promotion excludes directors, members, partners, promotional and advertising agents, merchandisers, employees, any fleet or account business or consultants of the Promoter, their agencies, organizers and participating stores of the competition and the spouse, life partner, parent, child, brother, sister, business partner or associate of any of the said persons.

4. PROMOTION CRITERIA for South African residents/citizens

You can enter the promotion to stand a chance to win the takealot voucher giveaway, voucher lucky draw or the bonus voucher prize, by buying the following qualifying Continental branded tyres at any BestDrive fitment centre.

4.1 Eligibility for instant takealot vouchers:

Customers who purchase 18-inch Continental tyres or larger qualify for the following instant vouchers, in addition to automatic entry into the lucky draw for the 2,000 Cashback voucher:

• • • R500 instant voucher for purchasing 2 Continental Branded tyres.
    • R1,200 instant voucher for purchasing 4 Continental Branded tyres.
    • The number of takealot instant giveaway vouchers is limited to one voucher per customer.
    • Customers must scan the BestDrive getalot more promotion QR code with a smartphone.
    • After scanning the QR code, the WhatsApp on the customer’s smartphone will automatically open and instruct the customer to provide the following information:

a. Name
b. Surname
c. ID number
d. Image of the invoice
e. Name of the BestDrive fitment centre dealership they purchased the tyres

• • • Once all the information has been verified by WOW Programme Administrators, eligible customers will receive their takealot voucher within one hour of validation via the WhatsApp number used to enter the competition.
    • WOW Programme Administrators will conduct audits on certain claims at random.

4.2 To qualify for the takealot voucher lucky draw:

a. Eligibility for the R2,000 Takealot Voucher Lucky Draw:
b. Customers who purchase any 13-inch Continental branded tyres or larger qualify for the R2,000 Takealot voucher lucky draw.
c. Each purchase qualifies for one entry into the lucky draw.
d. To enter the lucky draw voucher prize, customers must follow the same entry process as outlined above.
e. The first lucky draw will take place on 9 December 2024.
f. Before finalising a winner for each BestDrive dealership, the WOW Programme Administrators will conduct a quality assessment to confirm whether the invoice qualifies.
g. Customers purchasing 18-inch tyres or larger qualify for both the instant vouchers and the R2,000 Takealot voucher lucky draw. Purchases below 18 inches do not qualify for any instant vouchers. The number of vouchers per customer is limited to one instant voucher per qualifying transaction and one lucky draw entry per purchase.

4.3 To qualify for the bonus takealot voucher prize:

• • • Once the promotion is complete, 10 customers will be contacted to return to the BestDrive dealership where they purchased the qualifying Continental branded tyre/s. There, a picture will be taken of them with the BestDrive dealer, where they purchased their tyre/s and receive a R500 Takealot voucher.  The picture taken will be published on Bestdrive media platforms.
      The second lucky draw of 10 customers will be from the customers who qualified for a takealot voucher lucky draw (first draw) will take place on 13 December 2024.

5. PROMOTION CRITERIA for Botswana, Namibia and Swaziland residents/citizens

• The getalot more promotion will be rewarded as cashback in Namibia, Botswana and Swaziland as indicated on the point of sale, and other communication, in either Botswana Pula (P), Namibian Dollars (N$) or Swaziland Lilangeni (E) - depending on the respective country. The promotional cashback will be rewarded immediately with a discount off the invoice by the participating dealer where the qualifying purchase was made.
• The promotional cashback offer cannot be transferred and must be used immediately against the transaction for which it was awarded to.
• The promotional cashback cannot be used against another or new purchase or transferred to an alternative purchase.
• This promotional cashback offer cannot be used in conjunction with any other promotional offer.

To qualify for the Cash Prize lucky draw and eligibility for the (P, N$ and E) 2,000 Cash Voucher:

• Customers who purchase any 13-inch Continental branded tyres or larger qualify for the (P, N$ and E) 2,000 Cash Prize lucky draw.
• Each purchase qualifies for one entry into the lucky draw.
• To enter the lucky draw voucher prize, customers must follow the same entry process as outlined above (section 4.2).
• The first lucky draw will take place on 9 December 2024.
• Before finalising a winner for each BestDrive dealership, the WOW Programme Administrators will conduct a quality assessment to confirm whether the invoice qualifies.
• Customers purchasing 18-inch tyres or larger qualify for both the instant cashback and the (N$, E, P) 2,000 Cash Prize lucky draw. Purchases below 18 inches do not qualify for cashback.
• The Cash Prize will be deposited into the winner’s bank account in December 2024.
• The number of cashbacks is limited to one cashback per qualifying transaction and one Cash Prize lucky draw entry per purchase.

6. QUALIFYING CONTINENTAL BRANDED TYRES

5.1 The following Continental branded tyres qualify for the BestDrive getalotmore promotion:

a. Passenger tyres
b. Light truck tyres
c. 4x4 tyres
d. Van tyres

7. PRIZE

7.1 The Promotion will afford the participant a chance to:

a. Receive a R500 or R1200 takealot voucher depending on whether you purchased 2 or 4 Continental 18 inch and above tyres, as per section 4.
b. Stand a chance to win a R2000 voucher when you have purchased a 13 inch and above Continental tyre.
c. Receive a bonus R500 takelot voucher if you get randomly selected and attend a photo opportunity.

7.2 For the avoidance of doubt, the number of entries to the promotion is not limited, however, the number of vouchers a customer can win is limited to one per type of voucher.

7.3 Promotional images are merely a representation of what the vouchers could be used for when purchasing items through takealot.

7.4 The vouchers are valid for 36 months from date of issue.

7.5 Prizes are not transferrable or exchangeable and shall not be redeemed for cash and if not taken up for any reason, they shall be forfeited.

7.6 Winners will accept the prize as is. The promoter reserves the right to substitute any of the prizes for a different prize of similar value.

7.7 The winner will be responsible for any costs resulting from accepting this prize

7.8 The Promoter will hold no liability for the use of this prize by the winner regardless of anything they purchase from takealot.

7.9 Entries will only be processed by WOW Programme Ambassadors on behalf of the promoter between 8:30 and 16:30 weekdays (Mondays to Fridays).

8. AWARDING OF PRIZES

8.1 All customers who purchase 18 inch and above Continental tyres and qualify for the prizes will be eligible to receive takealot vouchers as long as the total number of vouchers available are still available.

8.2 By entering the BestDrive getalotmore promotion, you give consent to have your personal details stored on WOW and allow WOW to communicate with you regarding this promotion, on behalf of the promoter.

8.3 WOW will conduct the lucky draws using Wheel of Names and the draw will be audited.

8.4 The Promoters decision is final, and no correspondence will be entered into.

8.5 For the R2000 takealot voucher lucky draw competition, should the winner not be contactable via cellphone within 24 hours to verify their details and invite them or a nominated representative to collect their prize, the prize will be transferred to the next randomly selected entry.

8.6 By accepting the prize, the takealot voucher giveaway winner or recipient consent to having their name and likeness publicly announced and shared on the BestDrive Facebook, Instagram and TikTok pages, for the purpose of declaring the winners of the giveaways and prizes. If the winner declines to have their picture or name shared, they will forfeit their claim to the prize.

8.7 By accepting the prize, the winner of the R500 bonus prize agrees to the collection of the prize from the BestDrive store where they purchased the tyre/s. If the winner is not available to collect the prize within 2 days of being informed, they forfeit the R500 bonus prize. The winner agrees to accept any costs associated with the collection of the prize from the BestDrive where they purchased the tyre/s.

9. INDEMNITY

9.1 To the extent permitted by the Consumer Protection Act and any other applicable law, where the Consumer Protection Act or any other such law applies:

9.2 The participant hereby indemnifies the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants’ entrance to the Promotion or acceptance of any prize.

9.3 The Promoter excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its gross negligence and/or fraud).

9.4 The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity and age) and to reject any participant who has not complied with these Terms and Conditions. Errors and omissions (E&EO) may be accepted at the Promoter’s discretion.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

9.5 The Promoter reserves the right to carry out reasonable due diligence to help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by Promoter in its sole discretion.

9.6 Neither the Promoter nor its agents or distributors will have any liability in relation to this promotion, to the extent permitted by law.

 10. PROCESSING OF PROTECTION OF PERSONAL INFORMATION

10.1 In addition to our Processing notice for suppliers and customers we set out below how we, as BestDrive South Africa, the promoter, collect, use, and share your Personal Information and the reasons why we need to use and process certain of your Personal Information to facilitate this promotion. Where we use service providers who process information on our behalf, we have concluded the relevant agreements with the service providers to safeguard personal information and the service providers adhere to the same or similar conditions for processing your personal information as we do.

10.2 The promoter will process your name, image, where applicable , identity number and cell phone number, in order to determine the winner / perform audits.

10.3 By participating in this promotion, you consent to your personal information described above to be processed for the purpose described above. You have a right to withdraw your consent at any time.

10.4 There is no automated decision making regarding this processing activity.

10.5 We do not collect personal information automatically.

10.6 The supply of the information by you is not mandatory. If you do not provide the information, you will not be able to participate in this promotion.

10.7 Your personal information will be collected from you or from our service providers who collect it from you on our behalf, and which will be shared on a need-to-know basis with certain third parties or employees of the Promoter, for the purpose of giving effect to this competition, including lawyers, advertising agencies, auditors, Information Regulator and the National Consumer Commission (NCC).

10.8 The Promoter may disclose a Participant’s information where it has a legal duty in terms of applicable legislation, or where it may be deemed necessary in order to protect the Promoter.

10.9 The Promoter will collect, store and use (not share) personal information of participants for communication or statistical purposes.

10.10 The Promoter may use names and images taken of the winners/participants for publicity purposes, without any further remuneration being payable to the winner. All promotional material will become the sole property of the Promoter. However, the participant/winner has the right to decline participating in any promotional activity or to object to these images being used by written notification to the Promoter at BestDrive South Africa (Pty) Ltd, Cadle Street, New Brighton West, Gqeberha Attention: Compliance Department, dataprotection@conti.co.za The written notification is to reach the Promoter by no later than the stipulated promotion period.

10.11 Once your Personal Information is no longer required due to the fact that the purpose for which the Personal Information was held has come to an end, such Personal Information will be retained for 3 years after the registration and thereafter deleted if there is no new legal basis to retain the personal information.

10.12 You have the right to access the personal information that the Promoter holds about you. You further have the right to request that the Promoter updates, corrects or deletes their personal information on reasonable grounds. The exercise of your right must be made in writing to the Promoter at BestDrive South Africa (Pty) Ltd, Cadle Street, New Brighton West, Gqeberha Attention: Compliance Department, dataprotection@conti.co.za.

 11. GENERAL

11.1 The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Promotion. Terms and Conditions, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary. All participants agree to waive any rights that they have in respect of this promotional competition and acknowledge that they will have no recourse against the Promoter or its agents.

11.2 The onus rests on the participants to check the website for updates to the Terms and Conditions.

11.3 No liability shall lie on the Promoter in favour of any participant, winner(s) and/or third party arising from such cancellation, suspension, or termination. Therefore, the participant waives their right which they may have against the Promoter and hereby acknowledges that they will have no right of recourse or claim of any nature whatsoever against the Promoter.

11.4 The Promoter may refuse to award the prize to any participant in the event that that they reasonably believe, in their sole discretion, that the winner is not eligible to receive the prize, has acted in a manner that is not in the spirit of the Promotion, their conduct can be reasonably interpreted as scamming or circumventing the terms and conditions of the Promotion, if there is any suspicion of any irregularities or fraudulent activities, if it would be unlawful to award the cashback. In addition, any entrants/participants/winners suspected of fraud will be disqualified from any future Promotions run by the Promoter or their associated agents.

11.5 If part or all of any the clauses of these Terms and Conditions is found to be illegal, invalid or unenforceable:

11.6 It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible.

11.7 It will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.

11.8 The Promoter reserves the right to disqualify any winner/participant without informing the winner/qualifier in case such winner fails to comply with the Promotion’s Terms and Conditions.

11.9 Any personal information submitted by you will be used solely in accordance with current South African data protection legislation and the Promoter’s privacy policy which can be found at https://www.bestdrive.co.za/data-security

11.10 All Terms and Conditions are subject to the laws of the Republic of South Africa and should a doubt or dispute occur, it will be taken before the Courts of the Republic of South Africa.

11.11 This Promotion is not applicable in conjunction with any other offers/ promotions offered by the Promoter.

11.12 This competition is in no way sponsored or endorsed by Facebook or any other social media or takealot.
