Please read these Terms and Conditions carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate. 

Please take note that important clauses, which may limit our responsibility; or place an obligation on you to indemnify us; or involve an acknowledgment of any fact; or involve some risk for you, will be in bold and italics. You must pay special attention to these clauses.  

The BestDrive “WE BUY TYRES” promotion will hereinafter be referred to as the “WE BUY TYRES” promotion. 

The Terms and Conditions set out below apply to all participants in the BestDrive WE BUY TYRES Promotion taking place in BestDrive retail stores nationwide in South Africa, including Swaziland and Namibia.

1. THE PROMOTION

1.1 The BestDrive WE BUY TYRES Promotion ("the Promotion") is conducted by Continental Tyre South Africa (Pty) Ltd (“the Promoter”), with registration number 1998/005020/07 and principal place of business at Cadle Street, New Brighton West,

2. THE PROMOTION PERIOD

2.1 The Promotion will take place from 15 November to 15 December 2023 (both dates inclusive).

4. HOW TO PARTICIPATE IN THE PROMOTION:

4.1.1 BestDrive customers that purchase a set of two (2) or more Continental branded tyres from 15 inch and up, qualify for a promotional cashback off their purchase price including VAT as per the table below: 

4.1.2 To qualify for the promotional cashback offer the BestDrive customer should be a retail customer (in other words “a consumer”) and must not be purchasing the tyres on behalf of a fleet or business

4.1.3 The promotional cashback as indicated on the point of sale and other communication is either denoted in South African Rand (ZAR) or Namibian Dollar (N$) or Swaziland Lilangeni (E), depending on the respective

4.1.4 The promotional cashback will be rewarded immediately with a discount off the invoice by the participating dealer where the qualifying purchase was made.

4.1.5 The promotional cashback offer cannot be transferred and must be used immediately against the transaction for which it was awarded

4.1.6 The promotional cashback cannot be used against another or new purchase or transferred to an alternative

4.1.7 This promotional cashback offer cannot be used in conjunction with any other promotional offer other than the BestDrive WE BUY TYRES

4.1.8 The promotional cashback per set of two (2) Continental branded tyres is not limited but only relates to one transaction (one invoice per vehicle) and the qualifying product would need to be fitted to the vehicle on the same day, to qualify for the

4.1.9The promotional cashback is subject to availability and while stocks of Continental branded tyres

4.2 The promotional cashback may include the charges attached to the fitment of the tyres; however, it excludes ALIGNMENT as this service is not attached to the fitment of

4.2.1 The price for the promotional tyres quoted by a BestDrive dealer(s) may be based on the promoter’s recommended retail price, however prices quoted may vary between BestDrive dealerships and is subject to change without prior notice.

4.2.2 The promotional cashback cannot be transferred or exchanged and shall not be redeemed for cash and if not taken up for any reason, it shall be forfeited.

4.2.3 The total national promotional cashback is valued at R1 500 000 (One Million Five Hundred Thousand Rand). Once the full value of the total national promotional cashback is depleted, the promotion will end, irrespective of the promotion The promotion will come to an end when the stock is no longer available or when the total national promotional cashback is depleted, whichever comes first. 

5. INDEMNITY

5.1 To the extent permitted by the Consumer Protection Act and any other applicable law, where the Consumer Protection Act or any other such law applies:

5.2 The participant hereby indemnifies the Promoter, its associated companies (directors, officers and employees) and agents against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants’ entrance to the Promotion or acceptance of any

5.3 The Promoter excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its gross negligence and/or fraud).

5.4 The Promoter reserves the right, at any time, to verify the validity of participants (including but not limited to a participant’s identity, age and place of residence) and to reject any participant who has not complied with these Terms and Conditions. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those

5.5 The Promoter reserves the right to carry out reasonable due diligence to help ensure that the use of any such person in advertising or publicity for the Promotion will not bring the Promoter or any of the Promoter’s brands into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promotion as determined by Promoter in its sole

6. PROTECTION OF PERSONAL INFORMATION

6.1 In terms of the law known as the Protection of Personal Information Act, 4 of 2013, (POPIA) the Promoters may have to process your personal information, where and if applicable, in order to perform audits thereafter and to make available to the Promoter all necessary Personal Information required for the purpose of facilitating the the competition.

6.2 Any personal information will be received directly from you or from our service providers, and which will be shared on a need-to-know basis with certain third parties or employees of the Promoter, for the purpose of giving effect to this competition, including lawyers, advertising agencies, auditors, Information Regulator, and the National Consumer Commission (NCC).

6.3 Whilst we hold your personal information, we will keep it safe and secure until the purpose for holding it has come to an end, whereafter it will be destroyed, and you accept that by entering the Promotion that you agree that we may process your personal information as indicated

6.4 The Promoter may disclose a Participant’s information where it has a legal duty in terms of applicable legislation, or where it may be deemed necessary in order to protect the

All promotional material will become the sole property of the Promoter. However, the participant/winner has the right to decline participating in any promotional activity or to object to these images being used by written notification to the Promoter at Continental Tyre South Africa (Pty) Ltd, Cadle Street, New Brighton West, Attention: Compliance Department, dataprotection@conti.co.za.The written notification is to reach the Promoter by no later than the stipulated promotion period.

6.11 Participants have the right to access the personal information that the Promoter holds about them. They further have the right to request that the Promoter updates, corrects or deletes their personal information on reasonable grounds. Once a Participant objects to the processing of their personal information, the Promoter will take all reasonable steps to amend the personal information accordingly. 7. GENERAL

7.1 The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Promotion. Terms and Conditions, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems All participants agree to waive any rights that they have in respect of this promotional competition and acknowledge that they will have no recourse against the Promoter or its agents.

7.2 The onus rests on the participants to check the website for updates to the Terms and Conditions.

7.3 No liability shall lie on the Promoter in favour of any participant, winner(s) and/or third party arising from such cancellation, suspension or termination. Therefore, the participant waives his/her right which they may have against the Promoter and hereby acknowledges that they will have no right of recourse or claim of any nature whatsoever against the

7.4 The Promoter may refuse to award a cashback to any participant in the event that that they reasonably believe, in their sole discretion, that the winner is not eligible to receive the cashback, has acted in a manner that is not in the spirit of the Promotion, their conduct can be reasonably interpreted as scamming or circumventing the terms and conditions of the Promotion, if there is any suspicion of any irregularities or fraudulent activities, if it would be unlawful to award the cashback. In addition, any entrants/participants/winners suspected of fraud will be disqualified from any future Promotions run by the Promoter or their associated

7.5 If part or all of any the clauses of these Terms and Conditions is found to be illegal, invalid or unenforceable:

8. PROMOTIONAL MATERIAL AND MARKETING ACTIVITIES

8.1 The Promoter may require a participant (at no fee) to be identified, photographed and the photograph or related article published / shared in social media, printed media, or to appear on radio and television, when accepting their prizes and/or after receiving their
